Services Description

Apex Softwares provides core banking, mobile banking, and financial technology solutions to financial institutions across Africa. We reserve the right to modify, suspend, or discontinue any service at any time.

User Accounts

To access certain services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use Policy

You agree not to:

• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services or servers
• Use automated systems to access our services without permission

Payment Terms

Payment terms are specified in your service agreement. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees at any time with 30 days notice.

Intellectual Property

All content, features, and functionality of our services are owned by Apex Softwares and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without prior written consent.

Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of business. This obligation survives termination of these terms.

Limitation of Liability

To the maximum extent permitted by law, Apex Softwares shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of data, profits, or business opportunities.

Indemnification

You agree to indemnify and hold harmless Apex Softwares from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use the services will immediately cease.

Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
